1. Who provides this service

The SelfSense app, this website (selfsense.me), and the SelfSense Event Server (including the hosted instance at server.selfsense.me) are provided by Ways Ltd, trading as Nodus Labs.

Throughout these terms, "we", "us", and "our" refer to Ways Ltd. "You" and "your" refer to anyone using the SelfSense app, website, or server (collectively, the "Service").

2. Acceptance of these terms

By installing the app, visiting this website, or connecting to the server, you agree to these Terms of Use and to our Privacy Policy. If you do not agree, please do not use the Service.

3. Not medical advice — important

SelfSense is not a medical device. It is not intended to diagnose, treat, cure, mitigate, or prevent any disease or medical condition.

The information, readings, scores (including DFA alpha, HRV metrics, breathing recommendations, and any interpretive labels), and content provided by the Service are for general informational and wellness purposes only. They are not a substitute for professional medical advice, diagnosis, or treatment.

Always seek the advice of a qualified healthcare professional with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay seeking it because of something you read on this website or saw in the app. If you think you may have a medical emergency, contact emergency services immediately.

If you have a heart condition, are pregnant, are recovering from surgery or illness, take medication that affects heart rate or blood pressure, or have any other condition that could be affected by breathing exercises, movement practices, or biofeedback training, please consult your doctor before using the Service.

4. Use at your own risk

You use the Service entirely at your own risk. You are responsible for:

  • Deciding whether any practice, exercise, breathing pattern, or movement recommendation suggested or facilitated by the Service is appropriate for you.
  • Stopping any practice immediately if you feel pain, dizziness, lightheadedness, chest discomfort, shortness of breath, or any other adverse symptom, and consulting a healthcare professional.
  • Making sure any third-party sensor (Apple Watch, Polar H10, Movesense, etc.) is used in accordance with its manufacturer's instructions.
  • Your own conclusions, decisions, and actions taken on the basis of information from the Service.

5. No warranty

The Service is provided "as is" and "as available", without any warranty of any kind, whether express, implied, statutory, or otherwise. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

  • Warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement.
  • Any warranty that the Service will be uninterrupted, secure, error-free, or free of viruses or other harmful components.
  • Any warranty as to the accuracy, reliability, or clinical validity of any reading, score, or interpretation produced by the Service.

DFA alpha, HRV, and movement-variability measurements are derived from consumer-grade sensors and statistical algorithms. They are approximate by nature. We make no representations as to their suitability for any specific purpose.

6. Limitation of liability

To the fullest extent permitted by law, in no event shall Ways Ltd, its directors, employees, contractors, agents, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to damages for personal injury, loss of profits, loss of data, business interruption, health outcomes, or any other intangible loss, arising out of or in connection with your use of, or inability to use, the Service — whether based on warranty, contract, tort (including negligence), or any other legal theory, and whether or not we have been advised of the possibility of such damages.

In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability is limited to the maximum extent permitted by law. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be excluded.

7. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
  • Attempt to gain unauthorised access to any server, namespace, account, or data that does not belong to you.
  • Interfere with, disrupt, or attempt to overload the Service or any infrastructure that supports it.
  • Reverse engineer, decompile, or attempt to extract the source code of the Service, except to the extent permitted by applicable law.
  • Resell, sublicense, or commercially redistribute the Service or any of its content without our written permission.

8. Intellectual property

All content on this website and in the SelfSense app — including text, images, code, designs, the SelfSense name and logo, the EightOS framework, and the underlying methodology — is owned by Ways Ltd or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may read, view, and use the Service for personal, non-commercial purposes. Any other use requires our prior written consent.

9. Beta status

SelfSense is currently offered as a free TestFlight beta. Features may change, break, or be discontinued at any time. We make no commitment to maintaining any particular feature or to keeping the beta running indefinitely.

10. Third-party services and links

The Service may link to or interact with third-party services, websites, or sensors (for example, Apple Watch, Polar H10, Movesense devices, App Store, TestFlight, external research articles). We are not responsible for the content, privacy practices, or terms of use of those third parties. Your use of any third-party service is subject to that third party's own terms.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason — including breach of these terms or to protect the integrity of the Service. You may stop using the Service at any time by uninstalling the app and discontinuing use of the website and server. Provisions of these terms that by their nature should survive termination will do so (including disclaimers, limitation of liability, and governing law).

12. Changes to these terms

We may update these terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of the Service after the change indicates acceptance of the updated terms. If a change is material, we will make a reasonable effort to notify users via the app or the website.

13. Governing law

These terms are governed by the laws of England and Wales. Any dispute arising out of or in connection with these terms or the Service is subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory consumer protection laws give you a right to bring proceedings in your country of residence.
